1. General & Agency Disclosure

1.1. These Terms of Service (“Terms”) apply to all bookings, travel packages, tickets, and related services purchased via our Shopify store or directly through our sales team.

1.2. By completing an order, paying a deposit, or accepting a quote, you (“the Traveler” or “Lead Passenger”) agree to these Terms on behalf of yourself and all persons included in the booking.

1.3. Role of the Company: Unless explicitly stated otherwise, we act as an organizer or sales agent marketing and selling travel packages, accommodation, excursions, and transport operated by vetted third-party suppliers (airlines, hotels, transport providers, local operators).

2. Booking, Payment & Deposits

2.1. Binding Agreement: A booking is legally binding once your order confirmation is issued and the required payment is processed.

2.2. Deposits: All deposits paid at the time of booking are strictly non-refundable. The deposit secures seat allocations, hotel blocks, and supplier commitments that incur immediate costs.

2.3. Balance Payments:

If a balance remains after the initial deposit, full payment must be received no later than 60 days prior to departure (or by the specific date stated on your invoice).

  • For bookings made fewer than 60 days prior to departure, the full amount is payable immediately upon checkout.

2.4. Late Payment: Failure to settle the remaining balance by the agreed due date grants us the right to cancel the booking without notice, retain the non-refundable deposit, and apply standard cancellation charges.

3. EU Statutory Cooling-Off & Flight/Package Cancellation Rules

3.1. Exemption from the 14-Day Right of Withdrawal:

Under EU Directive 2011/83/EU (Consumer Rights Directive), Article 16(l), statutory 14-day cooling-off rights (right of withdrawal) do not apply to passenger transport services or contracts for accommodation, transport, or leisure activities provided on a specific date or within a specific period. Once you complete your purchase, you do not have a statutory right to cancel free of charge simply because the purchase was made online.

3.2. Voluntary Traveler Cancellations:

If you voluntarily choose to cancel your booking after confirmation, the following conditions apply:

  • Deposit: Retained in full under all circumstances.
  • Flight Segments: Subject strictly to airline fare rules. Most discounted or promotional tickets are 100% non-refundable once ticketed. Any refundable taxes or fares will be returned minus an administrative handling fee.
  • Third-Party Services (Hotels, Tours, Activities): Governed by the respective supplier’s cancellation policy. Non-refundable hotel nights or activity slots cannot be reimbursed.
  • EU Package Travel Directive (Directive (EU) 2015/2302): Travelers may cancel a package prior to departure subject to reasonable termination fees. Where standard cancellation scales are not individually specified, termination fees reflect the price of the package minus cost savings and income from reallocating travel services.

3.3. Unavoidable & Extraordinary Circumstances:

In accordance with EU package travel legislation, travelers are entitled to cancel a package prior to departure without paying a termination fee only in the event of unavoidable and extraordinary circumstances occurring at the destination (e.g., active war, closed airspace, severe natural disaster, declared health emergency) that significantly affect package performance. In such cases, refunds are limited to sums recoverable from underlying service providers.

4. Booking Modifications & Name Changes

4.1. Passenger Information: It is the traveler’s sole responsibility to ensure that all names submitted during checkout or in subsequent forms match the traveler's passport letter for letter.

4.2. Name Change Fee: Any name correction, spelling amendment, or passenger substitution requested after booking confirmation is subject to an administrative fee of 500 DKK per name change, plus any additional fare differences or reissue penalties imposed by the airline or supplier.

4.3. Restrictions on Non-Transferable Tickets: Certain scheduled airlines treat name changes as full cancellations and re-bookings at current market rates. Any supplier-mandated rate differences will be billed directly to the customer.

5. Travel & Cancellation Insurance

5.1. Mandatory Traveler Responsibility: We do not provide personal travel, medical, or cancellation insurance.

5.2. It is an express condition of booking that travelers obtain their own comprehensive travel insurance covering:

  • Trip cancellation, interruption, and curtailment (covering medical emergencies or personal impediments).
  • Medical treatment, hospitalization, and emergency medical repatriation.
  • Baggage loss, theft, and delays. 5.3. We accept no liability for any expenses, losses, or damages incurred as a result of a traveler failing to secure adequate insurance cover.

6. Travel Documents, Passports & Visas

6.1. All travelers must hold a valid passport with at least 6 months’ validity beyond the planned return date (depending on destination regulations).

6.2. The traveler is solely responsible for verifying and obtaining all required entry visas, transit visas, ESTA/eTA electronic travel authorizations, and health/vaccination certifications.

6.3. We are not liable for denied boarding, refused border entry, or costs arising from improper or missing documentation.

7. Supplier Liability & Insolvency (Updated)

7.1. Operational Responsibility: Flight operations, schedules, delays, and baggage handling are the direct operational responsibility of the operating airline or carrier under applicable international conventions (e.g., Montreal Convention) and aviation regulations.

7.2. Supplier Insolvency & Absence of Travel Guarantee Fund:

  • The company is registered and operates in the Faroe Islands, where no statutory travel guarantee fund or insolvency scheme (Rejsegarantifond) applies or exists. We are not a member of any travel guarantee fund.
  • We accept no liability or obligation to reimburse prepaid amounts in the event of bankruptcy, insolvency, liquidation, or suspension of payments by any third-party airline, hotel, excursion operator, or transport provider.
  • Monies lost due to supplier insolvency cannot be refunded unless recovered in full from the insolvent entity’s estate. Travelers are strongly urged to ensure their personal travel insurance includes explicit coverage for End Supplier Failure / Insolvency.

8. Data Protection & Off-Platform Information Collection

8.1. Information Collection: While payments and core order details are handled through Shopify, personal travel details (e.g., passport copies, dates of birth, emergency contacts, dietary/medical requirements) are collected outside Shopify using Google Forms, secure company Google Drive storage, and direct email.

8.2. Purpose of Processing: This data is collected solely to issue airline tickets, manifest hotel rooming lists, comply with border control mandates, and ensure passenger safety.

8.3. Data Sharing: Collected data is shared strictly with the relevant airlines, accommodation providers, and local operators necessary to execute your travel package.

8.4. GDPR Compliance: All personal data processed via Google Workspace and Shopify is managed in compliance with EU/EEA General Data Protection Regulation (GDPR) standards. You retain the right to request access, rectification, or deletion of your personal data subject to statutory record-retention requirements.

9. Complaints & Governing Law

9.1. Any operational issues during travel must be reported immediately to the on-site supplier and our customer support team to allow an opportunity for resolution.

9.2. These Terms and any dispute arising from bookings are governed by the laws of the Faroe Islands, and subject to the exclusive jurisdiction of the Court of the Faroe Islands (Føroya Rættur).
